LucisArt 3 Product Return and Refund Policy

Please read this document carefully before downloading or installing the LucisArt 3 Software. The Product Return and Refund Policy that is set forth below (this "Policy") describes the conditions under which Image Content Technology LLC ("ICT", "we" and "us") will accept LucisArt 3 ED or LucisArt 3 ED/SE software ("LucisArt") returns and/or refund your money. As used in this Policy, "you" are an individual acting on your own behalf, or "you" are an agent of a person or entity that has authorized you to act on that person’s or entity’s behalf. We reserve the right to change this Policy without notifying you in advance.

1. Exception- Initial-Release LucisArt Extended Return Period and Support Period. Purchases on or before April 8, 2009 may be returned until April 15, 2009.

Customers wishing to return their copy of LucisArt must inform ICT no later than April 15 2009 at 5:00 pm EST and request a letter of Software Destruction. This letter of Software Destruction must be completed and faxed to ICT (fax: 508-346-3492) within 7 business days of the request. Refunds will be provided by applying the appropriate credit to the credit card used for purchasing LucisArt within 7 business days of receiving the Letter of Software destruction. Then please allow up to 7 business days for the banks to process the credit.

Technical support will be continued until October 15, 2009, for all LucisArt customers who bought LucisArt 3 on or before April 8, 2009.

2.Otherwise LucisArt returns are allowed for a period of 1 week after purchase.

Customers wishing to return their copy of LucisArt must inform ICT no later than 7 days after their purchase and request a letter of Software Destruction. This letter of Software Destruction must be completed and faxed to ICT (fax: 508-346-3492) within 7 business days of the request. Refunds will be provided by applying the appropriate credit to the credit card used for purchasing LucisArt within 7 business days of receiving the Letter of Software destruction. Then please allow up to 7 business days for the banks to process the credit.

If you were unable to successfully download and install the demo LucisArt software, do not buy LucisArt and please contact ICT using the e-mail address on the "Contact Us" web page.

3. Conditions for fixing mistaken orders.

If you ordered the LucisArt for the wrong computer operating system by mistake you may change your order to a LucisArt order for other operating system as long as you 1) notify ICT of the mistake within 7 days of purchasing LucisArt and 2) complete the Letter of Software Destruction within 14 days of purchasing LucisArt. The Letter of Software Destruction will be sent via e-mail to the customer within five (5) days of being notified of the order error.

The minimum order for LucisArt is one (1) copy of the LucisArt software. If you inadvertently order more copies of LucisArt then you intended your order will be refunded the cost of the extra copies of LucisArt with the condition that 1) the error is brought to ICT's attention within 7 days of purchasing LucisArt, 2) the order minimum of one (1) copy of LucisArt is met, and 3) the customer fills out and returns a Letter of Software Destruction within fourteen (14) days of notifying ICT of the order error. The Letter of Software Destruction will be sent via e-mail to the customer within five (5) days of being notified of the order error. Full refunds will not be given.

3. Downloadable LucisArt software only is available for International orders.

International customers must buy the downloadable LucisArt software and immediately create their own backup copy of LucisArt. Buying the CD version of LucisArt is not an option. The Tech Support and FAQs page describes how to create a backup copy of LucisArt. A basic understanding of how to write data to a CD or DVD is required.

4. Each copy of LucisArt comes with 6 months of limited phone and e-mail technical support.

Assistance with serial numbers, LucisArt software downloads, and incorrect orders (see section 2) will be provided.

Assistance with respect to installing LucisArt or creating a backup copy of LucisArt will not be provided except for the instructions posted on the web site and e-mailed to customers. Installing LucisArt requires some basic knowledge of computers. Customers without sufficient computer knowledge to install LucisArt must secure their own installation technical assistance.

5. Purchased technical support will be available starting October 15, 2009 for $50 US.

The online store will have a technical support incident item for sale. Please purchase technical support before contacting ICT to 1) provide serial numbers and 2) provide LucisArt downloadable software for sales not currently under the 6-month tech support period. Each purchase of technical support will provide the customer with one technical support incident and is valid for seven (7) days from the time of purchase.

Assistance with respect to installing LucisArt will not be provided. Installing LucisArt requires some basic knowledge of computers. Customers without sufficient computer knowledge to install LucisArt must secure their own installation technical assistance.

Purchased technical support will be available for as long as LucisArt is being sold.

6. Notice about hacked "LucisArt" software.

At some point the LucisArt software will be hacked and made available for free on the Internet. Prior experience with hacked LucisArt software indicates that sometimes it works and sometimes this hacked LucisArt software can corrupt a computer or infect it with viruses.

Product refunds will not be given because a purchased version of LucisArt will not operate due to a prior hacked LucisArt software installation.

7. Cross platform exchanges.

Cross platform exchanges are allowed provided the customer 1) has already purchased a copy of LucisArt, 2) purchases one Tech Support incident ($45 US) which will cover the expense of changing their order to the other software operating system and 3) the customer fills out and returns a Letter of Software Destruction. Dual platform operation requires purchasing two copies of LucisArt. Dual platform operation is not allowed with the purchase of one copy of LucisArt.
